We use the name "open source" generically in this case. The uploaders can pick which license they want to put the books under (including no license: PD).

while it is a bit of a debate, it appears that digitized PD books are still PD. digitizing books does not seem to pass the originality test to reset copyright. but then again, I am not an all knowing lawyer :)
